Legal Forum

Long gone are the days of real estate where deals were finalized on a handshake.

Long gone are the days of real estate where deals were finalized on a handshake. REALTORS need to keep up-to-date on changing laws and regulations and ethical requirements that guide their profession.

Many of these issues are covered in the EDGE, but what do you do if you have a question about real estate law? That’s where OREA’s Legal Forum can help.

Legal Forum provides a chance for REALTORS to find general real estate law information in one of two ways.

1. Search the Legal Forum database

2. Ask our legal expert

By searching the Legal Forum database, members can see if their question has been asked and answered previously. The database is organized into related topics such as: « Advertising & Promotions « Agency « Board Procedures « Brokerage Operations « Buying Properties « Commercial Properties « Commission « Condominiums « Ethics « Failure to close « Miscellaneous « MLS « Mortgages « Offers « Selling Properties « UFFI

Select a topic then click on the arrow of the drop-down menu to view the associated question sub-topics. Highlight the sub-topic you want and release the left-hand mouse button to open the file.

Legal Forum has recently reached a major milestone. Over 500 questions have been answered on our site since its inception, so there’s a good chance you’ll find the answers you’re looking for.

If you can't find the information you want on the database, then you can ask Legal Expert, Merv Burgard your question by filling in the “ASK MERV A QUESTION” form on the web site. Questions are usually answered and posted in three working days. You also receive e-mail notification that the answer has been posted.

Real estate lawyer Merv Burgard, Q.C., is a graduate of Osgoode Hall Law School and has been a member of the Ontario Bar for over 30 years. Merv serves as counsel to OREA, several boards, real estate brokerage firms and many REALTORS . He also writes the Legal Beat column in the EDGE.

An important thing to note about Legal Forum is that the information provided is not intended as legal advice or opinion – it merely provides a guideline. OREA members should seek legal advice on specific issues affecting them.
