OREA supports revision to Mortgage Brokers Act

The Ontario Real Estate Association has told the Ministry of Finance that it is prepared to accept changes to the deemed registration provision of the existing Mortgage Brokers Act that allows real estate brokers to be “deemed” mortgage brokers.

At present, under the provision, real estate brokers do not have to register under the act, pay registration fees or meet the current education requirements.

The association was responding to a consultation paper on improving the Mortgage Brokers Act released by the Ministry of Finance in late June. The review process is being headed up by Mike Colle, MPP for Eglinton-Lawrence and Parliamentary Assistant to the Minister of Finance. The review was first announced in the 2004 Ontario budget by Finance Minister Greg Sorbara who indicated that the government intended to table a new act in 2005.

In its response, OREA agreed that the Financial Services Commission of Ontario (FSCO), which currently regulates the mortgage brokerage industry, should have a way of tracking real estate brokers who also function as mortgage brokers. However, the association suggested that FSCO work with RECO to obtain that information, rather than set up a separate registration process.

The association rejected suggestions that real estate brokers should pay fees to register under the mortgage broker’s act as a thinly veiled new business tax.

OREA did agree that discussions should take place with all stakeholders regarding the current educational requirements in the mortgage brokerage industry.

At present, there are no education requirements for mortgage agents (individuals working for mortgage brokers) and only limited education for mortgage brokers themselves. OREA has suggested to the government that its real estate college may be able to play a useful role in improving education standards in the mortgage brokerage business.

OREA plans to continue discussions with the ministry during the fall and will comment when the new legislation is introduced next spring.
