How to deal with information requests

Under PIPEDA and the CREA Privacy Code, REALTORS have a responsibility to provide individuals with access to their personal information.

Under PIPEDA and the CREA Privacy Code, REALTORS have a responsibility to provide individuals with access to their personal information. Here are the key steps:

  • Help individuals prepare a request for access to personal information
  • Satisfy yourself that the person making the request is the person about whom the personal information exists
  • Ask the individual to supply enough information so you can effectively search appropriate records
  • Respond to the request quickly -- no later than 30 days after receipt of the request
  • Make sure the requested information is understandable. Explain acronyms,
    abbreviations and codes
  • Send any information that has been amended, where appropriate, to any third parties that have access to the information
  • If refusing to give access, inform the individual in writing of such refusal, setting out the reasons and any recourse available.
