New Ontario real estate act finalized

After 50 years without any substantive changes, a new Ontario Real Estate and Business Brokers Act (REBBA) was passed in December.

The new real estate legislation in Ontario will bring substantial changes including recognizing specialists, giving Realtors more flexible brokerage ownership provisions, and by increasing respect for the profession.

OREA lobbied the government for changes to the existing act, which has been in place for over 50 years because it didn't recognize the way that REALTORS work today - with the rise of franchises and the changing relationship between brokers and salespeople.

OREA has lobbied for several years to get changes to the Act. "This proposed new legislation is a major milestone in the association's ongoing efforts for legislation that reflects the reality of today's sophisticated marketplace," OREA President Brian Sukkau said.

So what does the new act mean for you?

1. Proposed changes include increasing fines, 2. New sections prohibiting brokers and salespeople from falsifying information or assisting others in falsifying information, 3. Requiring that brokers and salespersons be certified if they promote themselves as “specialists, 4. Further clarifying the roles of solicitors and auctioneers in real estate transactions.
