Parliament passes Do-Not-Call List

In response to widespread support of Canadians in favour of a national Do-Not-Call List, Parliament recently passed legislation to reduce intrusive telemarketing calls through Bill C-37: An Act to Amend the Telecommunications Act.

The legislation will allow individuals who do not wish to receive unsolicited telemarketing calls to add their telephone number to a single, centralized list that telemarketers will be required to download regularly and respect. The law allows for certain exemptions, for example, within pre-existing client relationships, where a transaction or inquiry has occurred within a given time frame.

REALTORS® will be required to abide by the federal Do Not Call List once it is implemented by the CRTC (implementation is expected by mid-2007). The CRTC will soon commence consultations regarding the operation and implementation of the list and CREA expects to participate in the consultations.

OREA’s 2006 and 2007 Legal Resource Committees will work with CREA to provide Ontario REALTORS® and real estate boards with information on how to comply with the Do Not Call List well before the time that this new law takes effect.
