Typing on a laptopA private member’s bill that would facilitate the use of electronic agreements of purchase and sale for real estate transactions was introduced recently in the provincial legislature, and the concept has been endorsed by the Ontario Real Estate Association (OREA). The bill supporting legislation that would allow electronic transactions was introduced at Queen’s Park and was co-sponsored by Progressive Conservative MPP Todd Smith (Prince Edward-Hastings) and Liberal MPP Yasir Naqvi (Ottawa Centre). Currently, Ontario REALTORS® are reluctant to use electronic agreements of purchase and sale because they are exempt from the legal protections provided by the Electronic Commerce Act, 2000. "Enhancing legal protection for electronic agreements of purchase and sale will allow consumers and REALTORS® to benefit from technology that makes real estate transactions more efficient, accessible and secure," says OREA president Ron Abraham. The legislature’s spring session ended in June, but OREA is continuing efforts to promote the bill and is hopeful it will pass in the future.
