CREA successfully won its recent battle to have “Realtor vs. Realtor”, a Canadian real estate reality TV series, taken off the air. CREA aggressively pursued CanWest and the show’s producers over the unauthorized use of its REALTOR® trademark in the series’ title and threatened legal action if the program continued to broadcast.

In a memo issued to all boards across Canada, Bill Harrington, CREA senior legal counsel said that the use of the REALTOR® trademark in the show’s title is an infringement of CREA’s intellectual property rights. "However, what is even more outrageous is the fact that HGTV would associate the REALTOR® trademark with conduct that violates the spirit and likely the letter of the REALTOR® Code."

CREA complaint heeded by network
Following CREA’s complaint, HGTV quietly removed “Realtor vs. Realtor” from broadcast, as well as from its website, after only a few shows had aired. CREA said in a statement that the show will resurface in 2010 under completely new branding. All references to REALTOR® will be removed.
