Now that privacy is law, how should you handle a request about personal information?
Under the Personal Information Protection and Electronic Documents Act (PIPEDA), an individual has the right to access any information you have on him or her. If someone makes a written request and provides satisfactory identification, firms must inform the individual if they have any personal information about them, explain how that information is or has been used and provide a list of any organizations to which it has been disclosed.

A real estate brokerage must also give individuals access to their information and the opportunity to correct or amend any personal information if it’s not accurate or complete.

Under the new law, all real estate firms in Ontario should have appointed a privacy officer and have a privacy policy in place.  The privacy officer is responsible for handling requests for personal information and any privacy related complaints.
