The Encroaching Septic Tank

While surveying a neighbouring property, the surveyor observed that the septic system servicing the insured's property appeared to encroach onto the other property.

While surveying a neighbouring property, the surveyor observed that the septic system servicing the insured's property appeared to encroach onto the other property. The surveyor brought the matter to the attention of the insured and the neighbour. The neighbour then asked the insured to either remove the septic system from his property, or purchase the land on which is was located.

After obtaining a surveyor's report which confirmed the encroachment and its extent, the title insurance company agreed to cover the cost of purchasing the strip of the neighbour's property where the septic tank encroached, along with the cost of a severance application.
