RECO makes improvements to CCD process

Over the past year, the Real Estate Council of Ontario (RECO) has made some notable improvements to its Complaints, Compliance and Discipline (CCD) process.

The first improvement was the introduction of the Option Letter. RECO developed this letter in mid-2002 to provide respondents, who admit to their contraventions, the option of entering into an Agreed Statement of Facts, which can reduce the amount of time a respondent, spends in the Discipline Hearing process.

Members who wish to enter into an Agreed Statement of Facts attend a Pre-Hearing (another enhancement to the process), which allows the parties involved in the complaint to review the case informally and without prejudice.

In most cases, respondents will usually sign the Agreed Statement of Facts and Penalty in which they acknowledge their actions, without having to proceed to a formal Discipline Hearing, which could take several months to convene.

From there, a Discipline Panel reviews the Agreed Statement of Facts and Penalty, and in most cases, approves the agreement on the next hearing date set for guilty pleas.

Very few complaints actually proceed to a Discipline Hearing. Of the 961 written complaints RECO received between April 1, 2002 and March 31, 2003, less than five per cent resulted in a formal Hearing.
