Two pamphlets available to OREA members contain plenty of important information to help you comply with the new REBBA 2002 regulations. Caveat REALTOR - Disclosing Defects is a brand new addition to OREA’s legal pamphlet series and Deposits and the Terminated Transaction has been revised to reflect the changes to the Act.

Deposits
REALTORS need to be aware of a number of changes regarding how deposits are dealt with in a typical real estate transaction. But how do you deal with deposits held in trust when the transaction falls through? The legal pamphlet, Deposits and the Terminated Transaction, clearly spells out what to do with deposits held in trust, where there is an ongoing dispute between the parties.

Disclosing defects
Do you know the difference between a latent defect and a patent defect? The issue of disclosing defects is more difficult for REALTORS than it is for sellers because they are bound by their codes of ethics – the CREA’s REALTOR Code and the RECO Code of Ethics – to discover the facts and look out for their clients. The legal pamphlet, “Caveat REALTOR - Disclosing Defects discusses the obligations of sellers and REALTORS when it comes to disclosure and how to handle this issue with both sellers and buyers.
